Conveyancing Costs

Our fees cover the work required to complete the purchase of your property* including dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England, or Land Transaction Tax (Land Tax) if the property you wish to buy is in Wales.

Please note that our fees are dependent on the value of the property being purchased/sold. A full quote will be provided to you upon request and further details of the property being received. Our minimum fee per transaction is £750.00 plus VAT (at 20% £150.00) and disbursements. We have provided a (non- exhaustive) scale of our fees below as well as a working example of potential costs, for your information.

* Our fee assumes that:

  • This is a standard transaction and that no unforeseen matters arise including, for example, (but not limited to) a defect in title which requires remedying prior to completion or the preparation of additional documents ancillary to the main transaction.
  • The transaction is concluded in a timely manner and no unforeseen complications arise.
  • All parties to the transaction are co-operative and there is no unreasonable delay from third parties.
  • No indemnity policies are required. Additional disbursements may apply if indemnity policies are required – please see below for further details.

Disbursements

Disbursements are costs related to your matter that are payable to third parties, such as search fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.

Please note: The cost of the searches can vary depending on the area in which you are purchasing the property and we will be able to confirm the exact cost when a bespoke quote is provided to you.

Leasehold Property Purchase – additional disbursements

When purchasing a Leasehold property there are certain additional disbursements payable which will be set out in the individual lease relating to the Property. The disbursements which we anticipate will apply are set out separately below. This list is not exhaustive and other disbursements may apply depending on the terms of the lease. We will update you on the specific fees upon receipt and review of the lease from the seller’s solicitors.

Anticipated Disbursements

  • Notice of Transfer fee – This fee if chargeable is set out in the lease. Often the fee is between £50.00 and £500.00.
  • Notice of Charge fee (if the property is to be mortgaged) – This fee is set out in the lease. Often the fee is between £50.00 and £500.00.
  • Deed of Covenant fee – This fee is provided by the management company for the property and can be difficult to estimate. Often it is between £50.00 and £500.00.
  • Certificate of Compliance fee – To be confirmed upon receipt of the lease, as can range between £50.00 – £500.00.

Stamp Duty or Land Tax (on purchase)

SDLT depends on the purchase price of your property and on your individual circumstances. You can calculate the amount you will need to pay by using HMRC’s website or if the property is located in Wales by using the Welsh Revenue Authority’s website.

Property Sale – Scotts Wright fees

Please note that our fees are dependent on the assumptions in paragraph 3 above, and the value of the property being sold as per the first table above. A full quote will be provided to you upon request and further details of the property being received.

Our minimum fee per transaction is £750.00 plus VAT (at 20% £150.00) and disbursements. We have provided a sample of sale disbursements below for your information.

  • Title Deeds - £8.40 (Freehold) £8.40 (Leasehold)

Our Conveyancing team consists of five fully qualified Solicitors who are ably supported by our secretarial staff and between us, we have a wealth of experience in both residential and commercial property matters. You can find out more information about our Solicitors on ‘Our People’ page. No matter who in our team handles your transaction, they will be supervised by Steven Scott, our Head of Property.

How long will my mortgage/re-mortgage take?

This depends on a number of factors such as whether you are re-mortgaging with the same lender or switching to a new bank or building society, or whether your property is subject to management company restrictions. On average, the process takes between 4-8 weeks.

Stages of the process

The precise stages involved in the re-mortgage of a residential property vary according to the circumstances. However, below we have suggested some key stages for your information.

  • We will take your instructions and investigate the title of the property.
  • Carry out a Local Authority Search or make arrangements for an appropriate indemnity insurance policy to be put in place. (This will entirely depend upon whether your new Mortgage Company requires a search to be undertaken).
  • Consider the Mortgage Company’s instructions and ensure that the terms and conditions of your mortgage are complied with.
  • Prepare the mortgage deed and any other necessary documentation.
  • Explain the content of the mortgage documentation to you and obtain your signature where appropriate.
  • Report to the Mortgage Company and obtain the mortgage advance if applicable.
  • Complete the re-mortgage (this is the date when the old mortgage will be re-paid and the new mortgage will commence).
  • Register the transaction at the Land Registry.
  • Forward the title documents to the Mortgage Company and account to you for any money held on your behalf.
